Terms and conditions

1. Services

Heads Consulting is the name under which Ignacio Cabezas González provides the following services:

• Executive search: sourcing and assessment of candidates for executive and professional roles.
• Business diagnosis: business analysis and action plan, with related advisory.
• Web development: custom websites and tools.

The scope, timeline and price of each service are set in the proposal or quote the client accepts. In case of conflict, that proposal prevails.

2. Invoicing companies

• HR Consultores invoices executive search, business diagnosis and advisory services.
• Valmont Lab invoices web development services.

There is no payment gateway on the site: all payments are made against an invoice, by bank transfer.

3. Payment terms

Executive search

• 30% at the start of the search.
• 30% on delivery of the mid-stage shortlist of assessed candidates.
• 40% at closing, when the chosen candidate accepts the offer.

If the client freezes or cancels the search midway, amounts already earned for completed stages are non-refundable.

Web development

• 50% deposit to start the project.
• 50% on delivery.

The domain is purchased by Heads with the deposit and remains in Heads’ name for at least the first year. Afterwards, at the client’s request, it is transferred to the client.

On-site diagnosis

It is paid before the visit. The diagnosis delivers an action plan; implementing it is the client’s responsibility, unless contracted separately.

4. No guarantee of hiring or retention

I work rigorously to present the best candidates, but the hiring decision is always the client’s and the decision to accept is the candidate’s. I do not guarantee that a search ends in a hire, nor the retention of the hired candidate in the role.

For candidates: applying does not ensure being presented or hired.

5. Confidentiality

I treat client, role and candidate information as confidential. The client undertakes to use the information on presented candidates only for the search and not to share it with third parties. This obligation continues after the service ends.

6. Intellectual property

The following belong to Heads Consulting and may not be copied or reused without written permission:

• This site, its design, copy and code.
• The reports delivered and the Heads Consulting CV format.
• The Heads Consulting Assessment and its methodology.

The client may use the reports it receives for its own internal decisions. In web development, once payment is complete, the client receives the rights to use the delivered site, as set out in the proposal.

7. Limitation of liability

Reports and recommendations are professional opinions based on the information available; decisions taken on them are the client’s. To the extent permitted by law, Heads Consulting’s liability is limited to the amount actually paid for the service giving rise to it, and does not cover lost profits or indirect damages.

8. Use of the site

By using the site you agree to provide truthful information, not to impersonate others and not to attempt to breach its security or access restricted areas. Site content is informational and may change without notice. The processing of your data is governed by the Privacy policy.

9. Governing law

These terms are governed by the laws of the Republic of Chile. Any dispute shall be submitted to the ordinary courts of Santiago.
